staged. and the surviving son of double murder, alex murdaugh, speaking out. denying today he had anything to do with the mysterious death of a former classmate. as this -- cold case is busting open tonight. let's go out front! that, evening i'm erin burnett, outfront tonight. if donald trump's very public prediction comes true, this would be the eve of his impending arrest. but cnn is learning tonight from sources that any irs would not happen. until next week if trump should be indicted this. week over hush money scheme involving a porn star when he first ran for president. now this is a live look outside the new york city courthouse. we do know there was a last ditch attempt by trump's legal team to keep the former president from being criminally charged. if that charge happens it will be a historic first. the last-ditch attempt has a name, it's a person, that person is robert costello. an attorney who's represented trump allies including steve bannon and rudy giuliani. he happens to be a former legal adviser to michael cohen. who admitted to paying out the 130,000 dollar to

stormy daniels. now castella and cola both fear today about having criminal courthouse, where a grand juries investigating that scheme. only costello testify today though. he appeared at the request of trump's team to counter cohen's testimony. he was there for nearly three hours, cohen was available for a battle but ended up not being needed according to his lawyer. the question of course did costello say anything today that would prevent trump from being charged in this game. he says he told gradually that cohen wants told him specifically that trump flat out did not know about the payment. >> that's what he said at the time, is it true, i don't know. >> did he tell the grand jury? that >> yes, i did. but i needed to force that into an answer. >> now, cohen blasted costello for making, quote false statements about, him during his testimony. >> bob

concerned about. they want to make sure that they can bring the former president and safely. and have mc his day in court. >> evan, obviously, in this case it's column that's likely to be the first indictment. surprising many. who thought it might come from elsewhere. specifically, many thought from fulton county. what could you tell us about the development there. the charges that are under consideration in fulton county, georgia, where the president and his team have filed to essentially take background jury record out of circulation? >> right, the new york district attorney certainly has catapulted his case ahead of what we all thought which was the case down in the special grand jury in georgia. was going to perhaps be the first because we've been hearing from that district attorney that it is decision would be a minute. and that weren't eminent is gonna be the one that's hanging over the former president. it's the case that he and his most worried about that it's because of what don lemon and others were reporting today the district attorney was considering racketeering and conspiracy charges. it's along the lines of what she's previously sad. was being considered but again, the idea being that the former president and his effort to remain in

kind of lawyer he is, his character? >> well, i think we need to be careful about equating a lawyer with -- whether it's a good thing, or bad thing. so, robert costello four starters is a former assistant u.s. attorney. in the southern district of new york. warm also part of that. office he has an excellent reputation. he did as a prosecutor. he did as a defense. lawyer he's honorable, of the lawyer. and i

have no doubt, zero, but i want to say double negative but he wouldn't lie under oath. >> oh. ahead >> whatever he brings to the table, i don't think he has an agenda other than to tell the truth. >> this is significant, because obviously a lot can be resting on him, he did come out after his three hours at the grand jury and spoke to -- he said he was frustrated with the experience. he said that he had wanted to talk about 300 emails that he had exchange with michael cohen. and he thought they were very important. but he said prosecutors didn't want to talk about, that they had -- here's what he said about it. >> they were getting upset because they asked me a limited question based on one of the six emails. and i volunteer information that i thought the grand jury needed to hear. >>, socialist s. a. t.? you he volunteered information -- that they would only ask about 60 miles when he had 300 he thought we were deported. >> where are, start no ones above the law including donald trump. but that needs to be viewed in a spectrum of we don't want to be involved and selective prosecution. we don't want to be prosecuting donald trump for about our wouldn't prosecute someone else for. i don't why the prosecutor doesn't just let it all come out before the grand jury. and let them decide. a target of the investigation such as mr., trump has a right to have the

think there is a chance. it is a prosecutor doesn't thorough investigation. and decided not to prosecute he has not failed and its obligations and i think that bob costello's testimony if nothing else should cause mr. perez to pause and think, is this the right case. if there are the facts of law. donald trump should be held accountable. and frankly, i don't think this is the case. and beyond a reasonable doubt bob castella's testimony gives the scale in favor of not bringing this case -- >> john, thank you very much i appreciate your time. and the context that we bring to this which is so important. -- out front now ryan goodman, basil smikle, and scott jennings. thank you very much to all of. you karyn, you worked in the manhattan da's office you're very familiar with all of. this you know obviously were there when there was a decision not to go ahead and indict another issues related to donald trump. how much do you think costello could impact the decision on whether or not to indict trump? >> at this point the alvin bragg will likely asked the ground jury to decide. they've heard all the evidence and they've heard costello he was there for over almost three

hours today. to say there was any selective questioning of him, he had almost two hours to say whatever it is he wanted to say. the grand jury will have heard his testimony, i think at this point, alvin bragg will likely leave it up to the grand jury to decide if they believe that this case beyond a reasonable doubt. it's not the standard of the gradually by the. lay the standard for the grander-y is probable cause. >> a simple majority,? right >> pretty much, but sometimes when the defense presents evidence, whether it's a defended testifying or other evidence that's exculpatory. again, almost three hours it's a long time to say whatever it is he had to say. i think that that could influence grandeur here. we'll see but i don't think that alvin bragg will not ask the ground jury to vote on this matter at this point. >> ryan, michael cohen, was not asked to

testify today. he was there to be prepared for. costello testified and they said they did not need michael cohen. which will see if that significant. but cohen then obviously went out and gave a television interview. and here's what he said. >> typical donald j trump play, out of the playbook, figure out how you're gonna muddy the water as best as you possibly can, denigrate -- disparage, them and they did the same thing to cassidy hutchinson, and they did the same thing to anyone and everyone. it's for the truth -- >> so, he goes on to say the beauty is i have facts. now obviously -- the costello and his in a petulant equity and his reputation. but what is this comedown do that for a ground jury? >> i think in part of my come down to cohen testifying. but then what is there to cooperate what he has to say. prosecutors often have

to include accomplices to the crime, or bad actors especially when they're prosecuting organized crimes. you're gonna have prosecutors witnesses like that who have flipped on cooperating that aren't the most appealing character. is that i've done things like lie, past crimes but you need to then go through and corroborate anything. there's cooperation in the case of the form of checks that are written by donald trump. an audio recordings with donald trump and michael cohen another witnesses that can testify as. well part of this involved in national choir is part of the hush money payments. game and they have public document with the federal prosecutors that explains a role in the scheme. and that it was done to influence the election. there's a lot of cooperation, a

question of whether that could be put together in such a way that would convince injury and it's an open question. >> that's the open question, you also have of course i'm da here, unelected decision, there's a lot at stake. you want, reelection some da with assume they always want to do the right thing. those pressures, after everything that the da, alvin bragg's gone through here, is there an off ramp for him if he wants one, he or will he say he's gonna go ahead and this to the grand jury. is there an afferent if he wants one? >> he's an incredibly different difficult position, here's a guy, and i know i voted for him. if you look at his background he's representing what caller, he's been involved in white collar crimes, or fraud investigations. he worked at the u.s. attorneys, office kind of understands how that works, despite what may happen in new york or maybe even counterintuitive to being an elected official in new york. he's gonna try and stay out of the papers and off the tv because he wants to be very careful. only other hand he campaigned as a terminal

justice reform, anna, such particularly donald trump -- ran on taking him out of office if he had one. so he's an incredibly difficult position because if he chooses not, if there is no indictment here, donald trump can, say, look my supporters got, off their they pushed it back and they're gonna be questions about whether or not he was up to the task. on the other, hand if there is an indictment, donald trump's gonna come out and, say look at this democratic salute, going after us. he won't see me, he'll say of. it's, so it's a tough position for him to be an. but i need to think that he has enough experience and support to least at a want to say hole back but at least be a lot more careful one would think the former president of the united states. >> you said something in your answer that caught my attention he said if he doesn't indict people say, he wasn't up to the task. what task? what's the? task is the task to get donald trump at all costs? or is the task to do

what's right, or to execute the loss, i think that's where republicans have legitimate questions about this prosecutor. is he thinking about his political constituency who'd say what you just said, get him, you weren't up to the task. or is he thinking about the law. as prosecutor he's downgraded something like 52% of felonies down to misdemeanors. he's taking a seven year old misdemeanor and inflating it to a convoluted novel felony. i think a lot of republicans are looking at him and thinking is he more political than justice minded here because of where he represents in the voters he has. >> since you asked for the last several years through t o impeachment hearings throughout january -- there's a constant push to hold him accountable. the question is is this whole holding i'm accountable? if the facts say that we need to move on and look at something else i get that, i think most voters would get that. but there's also gonna be this question of is there ever gonna come a point in time when donald trump will be held accountable for the thing >> -- it's a legitimate question. and >> i

♪ priceline. ♪ >> desantis versus trump. the looming threat of an indictment triggering the first real back and forth between the top two republican president contenders. kristen holmes is out front in west palm beach. as florida resident donald trump and florida governor ron desantis traded some nasty shots. and christiane, this was very direct today. all sparked by a possible indictment in new york? >> that's right, erin, this is the first time we actually heard florida governor ron desantis weigh in on this potential indictment. and the thing to keep in mind here is that this was not on force, we

saw all weekend long trump allies and advisers essentially goading desantis into responding. at one point trump super packed with sending out what was essentially a tracker, showing all the republicans that had rallied behind. trump and signaling out desantis for not commenting at this time. when desantis got up there we heard him say the traditional rally cry, the da was politicized, he vowed not to get involved if this somehow trickled down into florida where they both lived. however, he didn't fully support trump, and he seemed to take a jab at him when he said this. >> i don't know what goes into paying hush money to a porn star, to secure silence over some type of alleged affair. i just can't speak to that, i have no interest in getting involved in some type of manufactured circus by some sort of da. he's trying to do a political spectacle. he's trying to virtue signal for his base. i've got real issues i

gotta deal with here in the state of florida. >> so, when you talk about real issues, that's actually the part that trump allies and advisers took issue with. they say it shows that desantis doesn't understand what the base republicans feel. that they actually care about this. they tore him apart on social media. but former president trump of course not one to be left out of a mud fight. he also responded to that first part about those payments. this is what he said, he said ron desanctimonious will find out all about false accusations and fix story sometimes in the near future as he gets older, wiser, and better known when he's unfairly and illegally attacked by a woman, even classmates that are, quote, under age. he shared a photo that suggested that the santas had acted in appropriately with teenage girls while he was teaching history in georgia when he was in his twenties. something that he shared on several occasions when he is slamming desantis. just showing you how ugly this

is gonna get. this is a year and a half out and desantis hasn't entered the race yet and this is what we're seeing. >> kristen, thank you very much. it was pretty amazing i will say -- i wouldn't know about how many times you get the word hush money and pornstar in there? all right then defended it was politically that would be walking the hype. >> the virtue signaling, it's a great line. listen, i think that's one of the things that would scare donald trump. the fact that number one, one desantis as the governor has elect -- executive authority. he knows how to use his budget to get his political ends. this is the same guy who was influencing these hyper local school board elections. so it's clear that he knows how this thing works. for him to be able to go up on tv every single time and say, i don't know how hush money works. i mentioned that'll be over and over again, commercials everywhere. >> and amazing that that wasn't the part that up such trump.

trump was set by another part of the statement. and he responded by taking it straight down to the gutter. >> absolutely, i've been trying to sort out the politics of all this today, the trump people are going crazy as a reporter pointed out. they're more angry with desantis than they are with bragg, if you just allies in through the lens of judgment, donald trump and, -- ron desantis did not cause bonton to have sex with the porn star while his wife was pregnant. dog one desantis isn't causing alvin bragg to bring a dog of a case. desantis give a reasonable answer today that i think would probably sound reasonable to 90% of americans. i thought he did a good job today. i don't understand why the trump people believe that it's an opinion it's -- a political opponent stomped defend him from his own judgment. desantis didn't do anything

that got trump into this trouble in the first place. >> i want to ask you, when we talk about the timing here, because i think this is important and don't know if a lot of our viewers -- this whole thing we keep talking about that, well, okay, the law is the law, if this is the right thing to do, then go ahead and indict. but then the people will still say, even if they believe there should be an indictment, not first, they shouldn't be the first one. they should be others first. there's a reason for that, you say. >> one often bragged was elected da about a year and a half ago, if you recall, there were three trump matters handed to him that were pending in the da's office. when was a case, right, the trump organization case that it already been indicted and went to trial, they got a 17 count conviction on it. there were two pending investigations that -- hadn't indicted yet either. one involving the valuation of his assets, one involving the stormy daniels hush money payments. alvin bragg came in, like both of them, and said, i want more evidence.

to the people who say that this is a political decision to bring this case, he had a case that he could've brought two months into his tenure, where the two prosecutors resigned in a huff because they thought there was enough evidence. this case, for the last year and a half, he's been gathering more evidence in both cases. this particular case, clearly, he feels that he can corroborate -- the statute of limitations is about to run in may. it's now or never with this case. >> which, rain, gives it more perspective. if he has till may, he said they're waiting to let fulton county go first, because he doesn't want to go first, or what? it does give some important context to this. >> absolutely. so, fulton county will probably go and may. if he waits, he could lose the case. he can't bring it. the statute of limitations has run. then he's not gonna wait for the department of justice -- the only make the decision sometime in the summer. that's why we have to bring this case now.

i just want to say, just to scott's point about, does it sound like a dog of a case -- it is a situation for the rule of law in which michael cohen was prosecuted and served time for the hush money payments and the federal government said that he acted in coordination and direction of the individual who weren't charged. the rule of law charges the principal in that kind of situation, but the subordinate serve time. the individual one was donald trump. >> we'll see what happens with individual one in the next coming days. thank so much. next, putin and xi jinping together in moscow as the russian leader was heckled in mariupol. [speaking non-english] >> this is not true. it's all fair share. that, obviously, was unexpected. i'm front now, the former ambassador to russia, sean sullivan. ambassador, when asked about that. but first, this visit, right, four and a half hours today, in the meeting tomorrow, the day after, this is nick pick visit. what is she jinping up to, spending all this time with putin? >> well, his mission is a lot more complicated than vladimir putin's approach to this mission. putin is very dependent on xi jinping. xi jinping has an audience other than putin in russia. he's looking at the eu. a huge market for china. it's very important for their economy. so he wants to be perceived as somebody who's interested in trying to make peace. he wants to maintain

credibility with the europeans. but he also wants to support putin in russia, because they're an enemy of the united states, and what frustrates us is good for xi. >> so, i have this visit, and certainly, putin wanted these visuals out there before xi arrived, he went to mariupol over the weekend. and while he was there, he allegedly met with ukrainian residents. and, then he got heckled with someone off camera. he saw his security detail suddenly swivel their heads. let me just play the moment for everybody. >> [speaking non-english] >> it did the security detail outside of next to him turn his hat. so, a person else, this is not true, it's all for show. which appeared to be reality sort of piercing i carefully staged visit. possibly an incredible moment. unclear exactly what happened. but how do you think this sort of thing, the sort of moment in this context, of going to mariupol for the first time,

going into the war zone here for putin, what impact putin, would sit with him? >> well, erin, one of the main purposes of the trip in visiting mariupol -- maple is a city that is reduced to rubble. drove the population out. he's going back, driving around himself in the car at night, trying to show that russia is rebuilding mariupol, life under russia in occupied ukraine is returning to normal, and what this heckler is saying is, it's all russia. it's all fake. it's all staged. he's come in at night, driving around at night. it's all russia. because the world knows that russia reduced that city to rubble. >> right. obviously, you see the buildings behind them. enough they put some sort of temporary facade on to make them look okay -- and as he's driving, you know, he's turning the wheel quite dramatically for what appears to be a straight road. i spoke earlier with -- you know her, ambassador.
